These Terms of Use (“Terms”) govern access to and use of CrispGate Photo Academy’s websites, courses, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any additional rules posted within the Service.

If you use the Service on behalf of an organization, you represent and warrant you are authorized to bind that organization to these Terms.

2. Eligibility

You must be able to form a legally binding contract in your jurisdiction to use the Service.

If you are under the age of majority, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

3. Accounts & Security

You may need an account to access certain features (such as purchased lessons or certificates). You agree to provide accurate, current information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate access to protect you, other users, or the Service, including in cases of suspected fraud, abuse, or security incidents.

Security tip

Use a unique password and enable device-level security (PIN/biometrics). If you share devices, always log out after a session.

4. License & Permitted Usage

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial learning, subject to these Terms.

Unless explicitly stated otherwise in writing, you may not:

  • copy, sell, resell, rent, lease, sublicense, distribute, or publicly perform course content;
  • reverse engineer, scrape, or systematically extract data or content;
  • remove proprietary notices or watermarking;
  • use the Service to build a competing offering or training library.

All rights not expressly granted are reserved. Content is licensed, not sold.

5. Payments, Trials & Refunds

Some parts of the Service require payment. Prices, taxes, and billing terms are disclosed at checkout or within the applicable offer.

Trials (if offered) may convert to paid access unless canceled before the trial ends. You are responsible for cancellation from your account settings or per the checkout instructions.

Refunds depend on the product type, delivery method, and access/consumption. Where local law grants mandatory rights, those rights prevail.

We may deny refunds where there is evidence of abuse (for example, repeated purchase-and-refund patterns or content downloading/redistribution attempts).

Digital courses

Typically refundable only when required by law or if explicitly stated in the offer.

Live workshops

May include cancellation windows; late cancellations can be non-refundable due to scheduling commitments.

6. User Content

The Service may allow you to submit content such as profile info, comments, photos, or assignment submissions (“User Content”).

You retain ownership of your User Content. You grant us a worldwide, non-exclusive license to host, store, reproduce, and display User Content only as needed to operate, improve, and secure the Service, and to provide features you request.

You represent and warrant that you have the rights to post your User Content and that it does not violate laws or third-party rights (including copyright, privacy, or publicity rights).

7. Prohibited Conduct

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:

  • breaking laws or encouraging illegal activity;
  • attempting to gain unauthorized access to accounts, systems, or networks;
  • interfering with or disrupting the Service (including via malware, bots, or excessive requests);
  • harassment, hate, threats, or any behavior that infringes others’ safety or rights;
  • impersonation, misrepresentation, or deceptive practices;
  • sharing access credentials or bypassing access controls.

We may investigate and take action, including removing content, suspending accounts, or contacting authorities where appropriate.

9. Third‑Party Services & Links

The Service may reference or integrate third‑party tools (for example, payment processors or video hosting). Third‑party services are governed by their own terms and policies.

We do not control and are not responsible for third‑party services. Use them at your own risk.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that content will be accurate, complete, or current.

11. Limitation of Liability

To the maximum extent permitted by law, CrispGate Photo Academy and its affiliates, officers, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 3 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnity

You agree to defend, indemnify, and hold harmless CrispGate Photo Academy and its affiliates, officers, employees, contractors, and partners from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms, used the Service unlawfully, or pose a security risk.

You may stop using the Service at any time. Termination does not affect any rights and obligations that, by their nature, should survive (including intellectual property provisions, disclaimers, and limitations of liability).

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page.

If changes materially affect your rights, we may provide additional notice as required by applicable law.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
